Why would you not need a trademark?

Well, this is not a very difficult question. Obviously, you do not need a trademark if you do not have a business. In this case, it seems very unlikely that you will ever require a trademark. However, if you have your own business, do you need to register your trademark?

Bonamark.com can assist you in protecting your intellectual property overseas. An international trademark service, Bonamark.com uses the Madrid System to help ensure your brand is preserved in foreign countries included in the World Intellectual Property Organization (WIPO). The Madrid System protects registered trademarks on an international level; Bonamark.com ensures that your intellectual property is recognized by the Madrid Protocol, and by extension, the WIPO. The United States and the vast majority of European countries — including the United Kingdom— all adhere to the Madrid Protocol. Any brands with a trademark that originates in these areas can easily utilize Bonamark.com to register that trademark internationally.

An international trademark is contingent on a few factors. First, the trademark must have been registered in a nation that is partnered with WIPO. Second, you cannot register internationally before you have registered locally. This fact means you will need to have your trademark 100% completed, registered, and recognized before you can successfully apply for an internationally recognized trademark. If at any point in time your local trademark is no longer recognized — for legal reasons or failure to renew — then your international mark will be considered invalid as well. If you lose your international trademark, then you will have to re-apply and start the registration process from the beginning, regardless of the circumstances that caused your local trademark to be considered invalid.

The fee for trademark registration will vary from country to country. That fee can be calculated by way of several specialty programs created for that purpose, the majority of which are free of charge. Trademarks registered internationally will not require you to renew with WIPO. Internationally registered trademarks are valid for 10 years — once ten years have passed, you will be able to renew your trademark for 10 more years.
