Brand Registration Process in Honduras
The registration process consists of a (1) formal examination, an (2) examination of distinctiveness and a (3) search for prior trademarks. Before registration, the trademark application is published in the Official Newspaper “La Gaceta” and the opposition period is 30 business days.
Any interested party may oppose the trademark.
The official fee is HNL 50.00 and the publication fee is HNL 3,500.00. The registration fee is HNL 700.00 + HNL 5.00 as the stamp fee.
A trademark registration is valid for 10 years starting from the registration date. The trademark can be renewed for periods of 10 years. If a trademark is not in use for 3 years, it can be canceled, however, the owner may pay the rehabilitation taxes, which prevent the trademark from becoming vulnerable to cancellation.
The grace period is 6 months from the expiration date of the trademark.
