An independent video game is a video game that is created without the financial support of a publisher. However, these games become increasingly more popular and financially successful.
No (or little) financial support determines how developers of indie games protect their intellectual property: they don’t. Once a game becomes successful, they try to #trademark the title and sometimes realize that it’s impossible or too late.
One of the problems is that indie developers create numerous indie games without knowing which of them will be successful. It might be too expensive to trademark all the titles in all the countries.
Even though money is scarce there is the Minimum Investment Strategy: apply for your trademark in at least one country right before launching your product.
It’s not that expensive (provided that you don’t file in the UAE) and you will have priority in almost any other country for 6 months. This will give you enough time to see if the title worth protecting in the rest of the countries.
When you register your trade mark, you’ll be able to:
1. Take legal action against anyone who uses your brand without your permission, including counterfeiters
2. Put the ® symbol next to your brand – to show that it’s yours and warn others against using it
3. Sell and license your brand
