Power of Attorney: A Power of Attorney (POA) is required for filing a trademark application in Paraguay. The POA must be notarized and sent to our attorney.
Trademark Search: It is advisable to conduct a trademark search before filing the trademark application to ensure that the proposed mark is available for registration.
Use Requirement: In Paraguay, there is no use requirement for filing a trademark application. However, if the mark is not used for a continuous period of five years after registration, it may become vulnerable to cancellation on grounds of non-use.
It's important to note that Paraguay follows the "first-to-file" principle for trademark registration, which means that the first person or entity to file a trademark application in Paraguay will generally have priority over others. 1. Trademark Renewals in Paraguay
A trademark is valid for 10 years from the date of registration. The owner of the mark must timely renew the trademark or the mark will be abandoned (canceled). The Trademark Office will notify the representative of the mark owner.
The renewal must be submitted 6 months before the expiration date or within 6 months of the grace period.
