Trademark registration in Singapore is a process of obtaining legal protection for a trade mark through the registration with the Intellectual Property Office of Singapore (IPOS). A registered trade mark gives the owner the exclusive right to use the trade mark in relation to the goods or services for which it is registered, and to take legal action against anyone who uses the trade mark without permission.

To register a trademark in Singapore, an application must be filed with IPOS.

A power of attorney is not required to file a trademark in Singapore, no prior use is required to file a trademark, no local office is required. Once the mark is filed by our attorney, the application process includes a formal examination, an examination of distinctiveness and registrability under the Trademark Act and a search for prior trademarks.

The processing time from first filing to registration is approximately from nine to twelve months.

Before the registration, the trade mark application will be published in the Trade Mark Journal. A registered trademark in Singapore is valid for 10 years from the date of application and the registration is renewable for the periods of 10 years.

Multiple-class applications are possible. Each additional class costs extra.

The application is filed at the Intellectual Property Office of Singapore (IPOS). According to the existing Trademark Law the mark is protected from the moment of filing

There are 3 main types of trademarks in Singapore: a logo (a design mark), a wordmark, a combined mark and a few non-traditional types.

All distinctive and graphically representable signs capable of distinguishing between goods and services of the proprietor from other traders, such as names, words, acronyms, numbers, letters, colors, devices, combinations or shades of colors, signatures, sounds, labels, tickets, three-dimensional forms, the three-dimensional form of a good or its packaging and any combination of the mentioned signs are registrable as a trademark.

Smell, hologram and movement marks as well are theoretically registrable. (NOTE: Movement marks and hologram and have already been registered in IPOS – smell marks are still theoretically registrable).

What if the deadline is missed?

The mark can be renewed during the late renewal period or grace period which lasts 6 months from the expiration date of a trademark.
